1. Overview and Commitment to Privacy

Next Level Fitness (“we”, “us”, “our”) is committed to protecting the privacy of individuals whose personal information we collect, hold, use and disclose. This Privacy Policy explains how personal information is managed in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
This Privacy Policy applies to all persons who access or use our facilities, including during staffed and unstaffed and after‑hours periods.  This Privacy Policy must be read in conjunction with our Membership Agreement, Terms and Conditions, Waivers and Facility Rules (together, collectively known as the Membership Documents).

Next Level Fitness (“we”, “us”, “our”) is committed to protecting the privacy of individuals whose personal information we collect, hold, use and disclose. This Privacy Policy explains how personal information is managed in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
This Privacy Policy applies to all persons who access or use our facilities, including during staffed and unstaffed and after‑hours periods.  This Privacy Policy must be read in conjunction with our Membership Agreement, Terms and Conditions, Waivers and Facility Rules (together, collectively known as the Membership Documents).

2. Meaning of Personal Information

“Personal information” means information or an opinion about an identified individual or an individual who is reasonably identifiable.
“Sensitive information” includes health information and biometric information (where applicable) and receives a higher level of protection under Australian privacy law.  At the date of this Privacy Policy, we do not use facial recognition or biometric identification technologies, unless expressly disclosed to members in writing.

3. Personal Information We Collect

We collect only information reasonably necessary for the operation of a fitness facility.  We collect and use personal information where it is reasonably necessary for the operation of our business, to meet legal and safety obligations, or where you have provided consent.

3.1 General Personal Information

Including but not limited to:

  • Full name
  • Residential and postal address
  • Email address and telephone number
  • Date of birth
  • Emergency contact details
  • Membership status and access privileges
  • Photograph of member

3.2 Access and Security Information

To operate a secure facility, we collect and generate:

  • Key‑fob, swipe‑card or mobile app access identification numbers
  • Date and time stamps of facility entry and exit
  • Access activity logs linked to individual memberships.

This information is collected for security, safety, compliance and operational management.

4. Methods of Collection

Personal information is collected when you:

  • Apply for, activate or use a 24/7 membership
  • Are issued or use a keyfob, access card or app
  • Complete member forms or waivers
  • Enter the premises during staffed or unstaffed hours
  • Appear on CCTV while accessing or using the facility.

5. Purposes of Collection and Use

We collect, hold and use personal information to:

  • Verify identity and eligibility for 24/7 access
  • Control and monitor secure entry to the facility
  • Maintain safety during unstaffed hours
  • Investigate incidents, injuries, misconduct or unauthorised access
  • Administer memberships, billing and compliance
  • Meet legal, regulatory and insurance obligations.

6. Membership Agreement and Access Conditions

By entering into a Membership Agreement and accepting access, you acknowledge and agree that:

  • Use of key‑fob or electronic access systems generates personal data
  • Access logs may be reviewed for safety, compliance and investigation purposes
  • Your access privileges may be suspended or revoked for misuse, including tailgating or sharing access devices
  • CCTV and access data may be used together to investigate incidents or breaches.

Consent provided under the Membership Documents authorises the handling of personal information as described in this Privacy Policy.

7. Disclosure of Personal Information

We may disclose personal information:

  • To staff, contractors and security providers as required
  • To emergency services in the event of injury or risk during unstaffed hours
  • To insurers, legal advisers or regulators
  • To law enforcement agencies where required or authorised.

We do not disclose personal information for unrelated commercial purposes.

8. CCTV Surveillance

8.1 CCTV Use

CCTV operates continuously across our premises to maintain safety and security, including during unstaffed hours.  CCTV may be installed in:

  • Entrances and exits
  • Training and common areas
  • External perimeters.

CCTV is not installed in bathrooms, change rooms or shower facilities.

 8.2 Use of CCTV Footage

CCTV footage:

  • Is used to monitor facility access, behaviour and safety
  • May be reviewed following incidents, complaints or suspected breaches
  • May be combined with access‑log data
  • May be disclosed to emergency services, insurers or authorities where required.

CCTV footage is typically retained for up to three weeks unless required for investigation, insurance or legal purposes. Access to footage is restricted to authorised personnel and is logged and monitored.

9. Children and Young People Under 18 Years

9.1 24/7 Access Restrictions

Unless explicitly permitted in writing, individuals under 18 are not eligible for unstaffed 24/7 access.

Where minors are permitted to attend:

  • Parental or guardian consent is required
  • Access may be limited to staffed hours
  • Supervision requirements may apply.

9.2 Information Handling

Personal information of minors:

  • Is collected and used only for approved participation
  • Is subject to heightened confidentiality
  • Will not be used for marketing without guardian consent.

Parents or guardians may request access to or correction of their child’s information.

10. Direct Marketing

Where permitted by law, we may communicate service‑related or promotional information. You may opt out of marketing communications at any time by using the unsubscribe function or by contacting us.

11. Storage, Security and Retention

We take reasonable steps to protect personal information, including:

  • Secure access systems and audit logs
  • Encrypted or restricted electronic records
  • Staff training on 24/7 risk management and privacy.

Information is retained only as long as required for business or legal purposes.

12. Access and Correction

Individuals may request access to or correction of personal information held by us, subject to lawful exceptions.

13. Data Breaches

Where notification is required, affected individuals and regulators will be notified as soon as practicable after becoming aware of an eligible data breach.
